Privacy Policy

Thanks for visiting Mudblu. In this Privacy Policy, we describe what type of information we collect and how it is used and shared. It should be noted that terms that start with an initial capital letter and are not defined in this Privacy Policy have the meaning established in our Terms of Service. If you do not agree with the terms of this Privacy Policy, you will not be able to access the Services or use them. 1. Fundamental Principles

When it comes to your personal information, we believe in transparency and we do not like surprises. Therefore, before going into detail, we want to share with you some of our fundamental principles. First, we do not sell your personal information to anyone. We just do not dedicate ourselves to this. Second, we do not ask for personal information unless we need it to provide Services or improve them. Third, do not share your personal information, unless you specifically authorize us to do so, or for the very limited purposes described below. Finally, we value the fact that, by using our Services, you provide us with information about you; therefore, we take this responsibility very seriously. Through this Privacy Policy, we assume the commitment to protect your rights and your privacy.


1.1. Registry. To use the Services, you must first create an account (hereinafter, the “Account”). By doing so, you agree to provide us with accurate, complete and updated information via PayPal for your Account. We probably have to use this information to communicate with you, telephone number and email.

1.2. Maintain Security Protect your Account and make sure that others do not have access to your Account and password. You must notify us immediately in case of losses, robberies or unauthorized, real or suspected uses of your Account or password through WordPress that Mudblu will provide whenever needed. You are solely responsible for the activity that is carried out with your username of your account, different from the username of your Mudblu web designer. Mudblu is solely responsible for any act within our user within WordPress, different from your username for security reasons, of your page.

1.3. Over 13 years of age. The Services have not been designed for children under 13 years of age; therefore, they should not use them. By making use of the Services, you declare to be over 13 years of age. Likewise, if you are under 18 years of age, your parent or guardian must indicate your agreement with this Common Agreement and must sign it on your behalf (depending on the place of residence).

2. Compilation

By using the Services, we collect the following information and use it exclusively for the purposes described below:

2.1. Information about the Account. This includes name, address, email address and phone number. We use this information in the way you would expect, such as to set up your Account or communicate with you.

 2.2. Information about Third Party Accounts. If you use Third Party Services, such as social networks or photo sharing services, you may provide us with information about the Third Party Services account, such as your user name (we do not store passwords that you use to access Third Party Services). We transmit, and may store, the information related to that account only as necessary to provide the Services and exclusively in accordance with the terms and policies of the Third Party Services.

 2.3. Information about Payments. When, in the beginning, you provide or update your payment information through Paypal. Paypal uses and processes your payment information in relation to Paypal’s Privacy Policy. We do not store information about payments, beyond the zip code and the country, that we need for billing and to comply with tax regulations and other types of government regulations. Phone number and email in order to start a working relationship with your designer.

 2.4. Communication with Us When you send us emails or other communications, such as customer service inquiries, with your designer we keep these communications and contents in order to resolve your queries or, in some other way, help you.

 2.5. Public Comments on the Services. We keep the comments, the contributions to the debates or the messages that are sent to the users of the Services in order to provide the Services.

 2.6. Files that You Send Us. When you use the Services, we store, process and transmit User Content (for example, photos) and information related to User Content (for example, photo location tags). We process and store such files and information in order to provide you with the Services, as described in our Terms of Services. 

2.7. Information on Use. This includes information about your activity on the Services and your interaction with them, such as IP address, type of device or web browser, the web page you visited before entering our sites and the identifiers associated with the devices. . This information allows us to analyze the way in which the Services are accessed and used, and to keep track of the Services.
 
2.8. Information about the location. Your devices (depending on the configuration) can transmit information about the location to the Services. We use this information to personalize, improve and protect the Services. For example, we may use information about your location to determine your language preferences or tag the geographic location of a publication.

2.9. Cookies and Other Type of Technologies. We use this type of technology to perform certain actions, such as remembering your preferences, maintaining your security and promoting the Services.

3. Shared Use

By using the Services, we may share your information exclusively as described below:

3.1. Third Parties Authorized by You. You can grant third parties access to information about your End Users of the Services. For example, you may wish to integrate Your Sites with a third-party newsletter service that requires access to the email addresses that you collect from your End Users, in order for that newsletter service to send emails on your behalf and with your adress. Simply, remember that the use that third parties make of this information will be governed by the terms and privacy policies of third parties.

 3.2. Compliance with the Law. We may disclose information to third parties in the event that we determine that such disclosure is reasonably necessary in order to comply with the law, protect our rights or prevent fraud or abuse of Mudblu or our users. Whenever we receive requests for information from law enforcement or national security agencies, we strongly believe in privacy and transparency. We analyze each application in detail and reject inaccurate, overly general or otherwise illegal requests. Whenever the law allows it, we send our users a notice that their information is being requested. The notice is provided so that you have the opportunity to reject such requests.

 3.3. Others who work for Mudblu. Mudblu uses certain trusted third parties to help us provide, improve, promote and protect the Services. For example, we may use third-party services to help us offer customer service, manage our ads on other sites or collaborate with data storage. These third parties may access, process or store your information in order to carry out tasks only for the purposes that we authorize and we ask them to offer, at least, the same level of protection to your information as described in this Privacy Policy. . Likewise, we may share with third parties combined or anonymous information that does not directly identify you.

3.4. Commercial Transfers If we participate in a reorganization, merger, acquisition or sale of our assets, the information will be transferred as part of that agreement.

4. Protection

While no service is completely secure, we have a security team that is responsible for keeping your information secure. We make use of security measures, such as firewalls, to protect against intruders, create redundancies throughout the network (so that if one server stops working, another can cover it) and we test the networks to protect them against vulnerabilities . The information about payments is transmitted through HTTPS encryption and we have the certification.

5. Conservation

We will keep your personal information for as long as it is necessary to provide the Services. You may request that your personal information be deleted at any time by deleting your Account. Everything except the domain or communicating with us at privacy@mudblu.com. Please note that there may be some delay in the removal of your personal information from our servers and backup copies, and that we may retain your personal information in order to comply with the law, protect our rights, resolve conflicts or enforce our agreements.

6. Location

The information you provide through the Services may be transferred to countries that are not your country of residence (for example, to our servers in the US). In addition, we may store information locally on the devices you use to access the Services. Upon request, we will give you a copy of the personal information we keep. This request could generate a charge that will not exceed the charge prescribed by law.

8. Communications

Periodically, we may send you advertisements related to our services. We will also send you emails related to your Mudblu and Paypal transactions. Likewise, we will send you marketing or promotional communications; however, you may choose not to receive subsequent marketing or promotional communications, for which you must click on the indicated subscription cancellation link (or a similar phrase) included in such communications.

9. Information about the End User

9.1. Collection and Use of Information about the End User. You may use the Services to create or publish Your Sites, and Your Sites may have End Users. We may collect, use or delete the same types of information described in Section 2 above about your End Users, on your behalf and in accordance with your own instructions, and we will treat such information in accordance with this Privacy Policy. The purpose is to allow you to use the Services and provide them, improve them and protect them. For example, during the payment process, you can ask the End Users to indicate their name, address, email address and payment information in order to complete the orders through Paypal only.

 9.2. Your Relationship with End Users. We may collect, use or delete information about End Users at any time. We do not assume any responsibility for your relationship with End Users and we will not provide legal advice in relation to such matters.

9.3. Payment Information of the End Users. The payment information of the End Users may be processed through external Electronic Payment Processors together with those who integrate the Account, in accordance with the terms and policies of said Electronic Commerce Payment Processors. We will transmit the complete payment information about the End Users when they provide it for the first time or update it, so that we can transmit it to the Electronic Commerce Payment Processors that you accept to use. We do not collect or store payment information from End Users.

9.4. Message for End Users. Hello, End User. We hope that we can create your Mudblu website one day. However, Mudblu has no direct relationship with you. If you wish to make any kind of request regarding your personal information, contact your programmer / designer, since they are in charge of controlling the data. In this way, you can send us these information requests to us, which, with pleasure, we will answer them. We will keep your information in accordance with this Privacy Policy.

10. Protection of Privacy

10.1. Fulfillment. Mudblu complies with the EU and US Privacy Protection Framework. As established by the US Department of Commerce with regard to the collection, use and conservation of personal information that is transferred from the European Union to the United States.

10.2. Queries and Disputes. In case you want to ask any questions related to the certification of Privacy Protection, please contact privacy@mudblu.com first and we will respond in 45 days. For all types of claims that can not be resolved directly, our attorneys are the independent organization responsible for reviewing and resolving claims related to compliance with Privacy Protection. Should our attorneys fail to resolve your query, they may be entitled to request a binding arbitration process under the Security Protection Principles. For the purposes of enforcing Privacy Protection, Mudblu is subject to the investigation and compliance authority of the US Federal Trade Commission.

11. Modifications

We may modify this Privacy Policy from time to time and we will publish the most recent version on our site. In the event that, as from a modification, your rights are significantly limited, we will notify you accordingly in accordance with the procedures established in our Terms of Service.
